Section 01
These Terms of Service ("Terms") constitute a legally binding
agreement between you ("Client") and Noldea Digital ("we," "us," or
"our"). By submitting a quote request, making a payment, or engaging
our services in any capacity, you confirm that you have read,
understood, and agree to be bound by these Terms.
If you do not agree with any part of these Terms, you must not engage
our services.
Section 02
Noldea Digital provides the following services:

Custom website design and development

Mobile-responsive website builds

Basic search engine optimization (SEO) setup

Website hosting and publishing
-
Ongoing monthly website maintenance

Website updates and technical support
The specific scope of work for each project will be agreed upon prior
to any payment being collected. Any features or deliverables not
explicitly agreed upon are not included and may be subject to
additional fees.
Note
Our standard website package includes up to 5 pages. Larger or more
complex projects are scoped and priced separately.
Section 03
All prices are listed in Canadian dollars (CAD) unless otherwise
stated. Payment is required as follows:

Website Build: A deposit of 50% is due before work
begins. The remaining 50% is due upon completion, prior to the site
going live.

Monthly Maintenance: Billed monthly at the agreed
rate. The first month is due before the maintenance plan begins.
Work will not begin until the required deposit has been received. We
reserve the right to pause or withhold delivery of work if payment is
not received by the agreed date.
Important
Failure to pay the final balance will result in your website not
being published. Noldea Digital retains all rights to the design and
code until payment is received in full.
Section 04
No Refunds
All payments made to Noldea Digital are final and non-refundable. We
do not offer refunds under any circumstances, including but not
limited to: change of mind, dissatisfaction with the final result,
project cancellation, or failure to provide required content.
By making a payment, you acknowledge and accept this no-refund policy
in full.
We take quality seriously and work closely with every client
throughout the process to ensure satisfaction. We offer revisions
before launch to address any concerns. However, once payment has been
made, it is non-refundable regardless of the outcome.
If you have concerns at any stage of the project, we encourage you to
communicate them promptly so we can address them. We are committed to
delivering work you are proud of.
Section 05
To ensure your project is completed on time and to a high standard,
you agree to:

Provide all required content (text, images, logos, branding) in a
timely manner

Respond to communications and review requests within a reasonable
timeframe

Ensure all content provided is accurate and that you have the legal
right to use it

Not provide content that is unlawful, offensive, or infringes on
third-party rights

Make payments by the agreed-upon dates
Delays caused by a failure to provide content or approvals are not the
responsibility of Noldea Digital. Project timelines will be adjusted
accordingly and do not constitute grounds for a refund.
Section 06
We include a reasonable number of revisions as part of every website
project. Revisions are changes to the existing design or content and
must be requested before the website is launched.
Revision requests that significantly change the original agreed-upon
scope — such as a complete redesign, additional pages, or new features
— may be subject to additional fees. We will always communicate any
additional costs before proceeding.
After Launch
Once your website has gone live, any changes or updates fall under
our monthly maintenance plan or are billed separately depending on
the scope.
Section 07
We aim to complete standard website projects within
1–2 weeks from the date we receive all required
content and the initial deposit. Timelines are estimates and may vary
based on project complexity and client responsiveness.
Noldea Digital is not liable for delays resulting from late content
delivery, slow client approvals, or circumstances outside of our
control. In such cases, project timelines will be extended and do not
constitute grounds for a refund or dispute.
Section 08
Upon receipt of full and final payment, the Client is granted
ownership of the completed website design and its content. Noldea
Digital retains the right to display the completed project in our
portfolio and marketing materials unless otherwise agreed in writing.
Until final payment is received in full, Noldea Digital retains all
rights to the website, including the design, code, and any work
produced. The Client may not use, copy, or publish any part of the
work until payment has been completed.
The Client is solely responsible for ensuring that all content,
images, logos, and materials provided to us do not infringe on any
third-party intellectual property rights.
Section 09
Our monthly maintenance plan is available at
$59 CAD per month. This plan includes regular
updates, security monitoring, performance checks, bug fixes, and
priority support as outlined in our service description.
The maintenance plan operates on a month-to-month basis with no
long-term contract. You may cancel at any time by providing written
notice before your next billing date. Cancellations take effect at the
end of the current billing period.
Monthly payments are non-refundable. If you cancel mid-month, you will
retain access to maintenance services until the end of the paid
period, but no partial refunds will be issued.
Section 10
Website hosting is dependent on active subscriptions and third-party
platforms. If a hosting subscription is cancelled — by either Noldea
Digital or the Client — the website may be taken offline.
Noldea Digital is not liable for website downtime caused by
third-party hosting platforms, server outages, or technical issues
outside of our control. We will make reasonable efforts to restore
service as quickly as possible.
Important
If your website is hosted through Noldea Digital's account and your
monthly plan is cancelled, your website may go offline. We recommend
discussing hosting arrangements with us before cancelling any plan.
Section 11
Noldea Digital shall not be held liable for any indirect, incidental,
special, or consequential damages arising from the use of, or
inability to use, your website. This includes but is not limited to
loss of revenue, loss of data, or loss of business.
Our total liability to any client for any claim arising out of or
related to our services shall not exceed the total amount paid by the
Client to Noldea Digital for the specific project in question.
We do not guarantee specific business results, search engine rankings,
or revenue increases as a result of our work.
Section 12
Either party may terminate a project by providing written notice. If
the Client chooses to terminate a project after work has begun, all
payments made up to that point are non-refundable. Any outstanding
balance for work completed up to the point of termination remains due
and payable.
Noldea Digital reserves the right to terminate a project or refuse
service at our discretion, including in cases where the Client has
violated these Terms, provided unlawful content, or behaved in a
manner that is abusive or disrespectful toward our team.
Section 13
Noldea Digital reserves the right to update or modify these Terms at
any time. Changes will be posted on this page with an updated
effective date. Continued use of our services after changes are posted
constitutes acceptance of the revised Terms.
We encourage clients to review these Terms periodically to stay
informed of any updates.
